Legalizing Marijuana, An Ethical Perspective

In today’s society, many ethical concerns arise on a daily basis, especially when it comes to the topic of legalizing marijuana. Many individuals have relied on the fact that marijuana was illegal, when determining whether smoking it should be considered unethical.However, many studies have shown that the effects of marijuana are not as detrimental as they were once made out to be. Legalizing marijuana can be an extremely controversial topic because several people have strong beliefs concerning why it should not be legalized, while a significant amount of people have stronger arguments, as to why it should be legalized.When it comes to looking at the ethical standpoint of legalizing marijuana, everyone has a different interpretation as to why marijuana should or should not be legalized. This is because everyone’s sense of morals and values differ from one another.Legalizing marijuana for medicinal and recreational use would be beneficial for large amounts of people for many reasons. The theory of utilitarianism implies that the proper course of action should be the one, which benefits the greatest number of people.Many aspects of legalizing marijuana should be considered when determining if the benefits outweigh the risks. Several states have passed laws, which govern the use of marijuana for medicinal purposes. In fact, over twenty states, as well as the District of Columbia have enacted laws that govern the use of marijuana for medicinal purposes only. The increasing number of physicians implying that they would use marijuana medicinally for their patients shows that there are many benefits, which could derive from using the substance.A study conducted by American herbalist showed, â€Å"79. 5 percent of professional members stated that if there were not legal prohibitions they would use cannabis clinically† (Romm & Romm, 2010, p. 25).This study also implies that the top reasons for prescribing marijuana include appetite loss, cancer, pai n, glaucoma, insomnia, and it is also said that it helps with relaxation. Considering the increasing number of patients suffering from such diagnosis, the utilitarian approach shows that legalizing marijuana for medicinal purposes would benefit the greatest number of people.When considering the harmful and destructive nature of alcohol and tobacco, it is hard to interpret why and how these substances became legalized. While at the same time, people are curious as to how a substance, such as marijuana, that controversially could result in more advantages than disadvantages, has yet to become legal. Marijuana is significantly less destructive than alcohol and tobacco and is used to treat medical conditions. State legislatures have ignored the signs of potential advantages of legalizing marijuana for years.However, legislatures have previously legalized substances, including alcohol and tobacco, without the advantage of the substances advancing or improving medical care. Therefore, the main ethical argument against legalizing marijuana comes down to the fact that of the legalities governing it's use. The National Organization for the Reform of Marijuana Laws (NORML), is an organization that serves as an information center for issues concerning marijuana use and legalization. The NORML Organization also serves as the voice for American's opposing the current marijuana prohibition.This organization presents the fact that if people are using this substance for enjoyment, those people should not be subjected to civil penalties or criminal injustices. A recent government study has shown that over 14 million American's use marijuana on a regular basis, despite legalities (NORML, 1996, para. 1). The NORML organization has compiled a list of principles of responsible use, which could reduce the amount of ethical concerns and legalities associated with using marijuana for recreational and medicinal purposes.One of which include the use of marijuana being restricted only t o adults. This is important because, just like alcohol and tobacco, it is unethical, immoral, and irresponsible to provide such substances to children.Another principle includes restrictions on driving while under the influence of marijuana. NORML stated, â€Å"Although cannabis is said by most experts to be safer than alcohol and many prescription drugs with motorists, responsible cannabis consumers never operate motor vehicles in an impaired condition† (NORML, 1996, para, 6). Therefore, the no driving principle is implied.These are two of the most significant principles presented by NORML. The next principle is described as set and setting. The NORML organization states, â€Å"The responsible cannabis user will carefully consider his/her set and setting, regulating use accordingly† (NORML, 1996, para. 7).Meaning, adults should be responsible enough, when using marijuana, to take into consideration several different aspects of one's life. For instance, it is important for marijuana users to consider his or her â€Å"set,† meaning the individual's attitude, personality, and experience.The term â€Å"setting† refers to an individual's physical and social condition or circumstances (NORML, 1996, para. 8). Therefore, individuals should consider and analyze a number of factors before choosing to smoke or just choosing to just say no. Two other principles presented by NORML include resisting abuse and respecting the rights of others. Therefore, individuals should steer clear of any sign of abuse and should not violate the rights of others when using marijuana.Decriminalizing marijuana would aid America's next generation in becoming more successful with the ability to prosper. By reducing the amount of young people being penalized and/or institutionalized for using or possessing marijuana, less lives will be destroyed as a result of the war on pot.Former President Jimmy Carter once said, â€Å"Penalties against drug use should not be mor e damaging to an individual than the use of the drug itself. Nowhere is this more clear than in the laws against the possession of marijuana in private for personal use† (NORML, 1996, para. 14).Therefore, even our former President considered legalizing marijuana to benefit the greatest number of people, due to the high volume of individual's lives being subjected to destruction as a result of using and/or possessing this substance. The former President also implied that the penalties governing drug use should not be more destructive than the actual drug itself. It has been proven and will continue to be proven throughout this paper, that there are ways to avoid possible ethical concerns raised in reference to legalizing marijuana.For instance, a recent study showed, â€Å" .  . . in the 16 states where medical marijuana is legal, there has been a drop of nearly 9% in traffic deaths since the laws took effect and a 5% drop in beer sales† (Crowe, 2012, para. 1). This st udy does not prove that driving while under the influence of marijuana is any less dangerous than driving while intoxicated. However, the results of the study do imply the fact that since alcohol is sold in bars and restaurants, it is more typical for higher rates of those driving drunk to have life threatening accidents than those under the influence of marijuana.Especially considering most marijuana users consume the substance in the privacy of their own homes. Whereas, individuals who choose to drink alcohol at a bar or restaurant, also choose to risk driving home while intoxicated. The author's of this study also imply that individual's driving while intoxicated are more likely to misjudge their perception and ability to drive, while those under the influence of marijuana typically tend to avoid taking risks on the road (Crowe, 2012, para. 11).However, individual's who choose to drive while impaired or intoxicated in any form are subject to being charged with driving under the i nfluence, which imposes severe penalties and will result in loosing driving privileges. Some may argue that marijuana is a gateway drug to harder drugs.However, the NORML Organization argues that, â€Å"For those minority of marijuana smokers who do graduate to harder substances, it is marijuana prohibition — which forces users to associate with the illicit drug black market — rather than the use of marijuana itself, that often serves as a doorway to the world of hard drugs† (NORML, 1996, para.  20).With that being said, it is not the use of marijuana that opens the doors for harder illicit drug use, it is being subjected to the underground market of marijuana that opens the doors for individuals to become familiar with other drugs. There are many ethical concerns when it comes to legalizing marijuana for recreational purposes. So far, two states have legalized marijuana for multiple reasons including medicinal purposes and recreational purposes.Washington and Colorado have implemented state laws governing the use of marijuana for recreational use. The Obama Administration and the Justice Department concluded in a recent announcement that federal agents will not intervene in Washington and Colorado’s new found marijuana laws and regulations as long as the states are, â€Å"preventing distribution to minors, stopping marijuana from being used as a cover for trafficking other drugs,  and enforcing laws against driving under the influence of drugs† (Dinan, 2013, para, 20).Therefore, as long as the states regulate the use and possession of marijuana, according to the previously stated guidelines, the federal government will not intervene with the state’s policies concerning the legalization of marijuana. The laws passed in Washington and Colorado are the first steps in the direction of decriminalizing marijuana.Those who are caught with an ounce of marijuana or less will not be subject to pay fines nor will they be ins titutionalized because citizens may legally possess anything less than an ounce. In recent years, the war on drugs has ruined thousands of young lives of those who were caught possessing or using marijuana. Decriminalizing anything less than an ounce of marijuana, when it is being used for recreational purposes, will ensure the judicial systems within the United States are reserved for more serious and/or violent crimes.The authors of Marijuana Legalization stated, â€Å"According to the FBI, there were 758,000 marijuana arrests nationwide in 2011, the vast majority for possession† (Sullum, 2013, para. 17). Therefore, most of the individuals who were arrested for marijuana in 2011 were actually arrested on possession charges, which most likely would not even be considered a crime in Washington or Colorado. Studies have shown that over fifty percent of American’s now believe marijuana should be legalized for recreational use because of the benefits outweighing the risks .Paul Armentano, the director of the National Organization for the Reform of Marijuana Laws recently stated, â€Å"Today, a majority of Americans espouse ending America's nearly century-long, failed experiment with cannabis prohibition and replacing it with a system of limited legalization and regulation† (PR Newswire, 2012, para. 5). By utilizing limited legalization and regulations on marijuana, less people would be put away for what would normally be considered a crime. In doing so, the future of many young people would be protected against being victims of the war against cannabis.From an ethical utilitarian perspective, it would be more beneficial for the greatest number of people, to legalize marijuana. Those who chose to possess and use marijuana are overcrowding prison systems and judicial systems within the United States. Implementing and utilizing methods of distributing marijuana, legally would decrease the amount of people being institutionalized for such crimes a nd could result in billions of dollars of tax revenue, which could strengthen the economy.The Seattle Times recently implied, â€Å"State financial experts estimate the new legalization could raise nearly $2 billion in tax revenue over the next five years, with the money going toward education, health care, substance abuse prevention and basic government services† (PR Newswire, 2012, para. 7). Herein lies, yet another ethical concept as to why marijuana should be legalized. An ethical egoist could argue that a person should have the right to use marijuana if that person sees using marijuana as being in his or her best interest.If not, the ethical egoist could argue that if that person does not see smoking marijuana as being in their best interest, they should not do it. No matter the direction the individual chooses to approach this situation, the ethical egoist would support the person’s right to make the determination for his or her self. Our textbook indicates, â₠¬Å"The egoist simply says that you should do what makes you happiest, or, again, maximizes your utility† (Mosser, 2010, sec. 1. 8, para. 22). With that being said, the utilitarian approach implies, the right thing to do is what benefits the largest number of people.However, the ethical egoist could possibly interpret, restricting one’s use of marijuana as being in his or her best interest. Based on the material presented and the information obtained while conducting research on the topic of legalizing marijuana, the logical notion would be to legalize marijuana. Having the ability to regulate and control the use and possession of marijuana among U. S. citizens, will provide the government with the ability to control its distribution Therefore, making availability to minors just as regulated and controlled as alcohol and tobacco, which would be in compliance with the Justice Department’s regulations.Almost half of our nation’s population previously voted to legalize marijuana. The government is beginning to realize, just like the use of alcohol and tobacco, the use of marijuana will continue legally or illegally. Legalizing marijuana for medicinal and recreational use would be beneficial for a significant amount of people for many reasons. Why not just develop regulations, apply taxes to it, and maintain control over it rather than continuing the â€Å"war on pot† which has failed tremendously over the years.

Complexity of Poetry Essay Poetry is a way for the reader to openly interpret a poem in almost any way they see fit. Because there is so much freedom of interpretation with poetry, there leaves a lot of room for discussion and opposition. Billy Collin’s poem, â€Å"Introduction to Poetry†, breaks down the basic ways for interpreting and understanding a poem. In summary, he explains that the reader cannot focus on trying to figure out one specific meaning of a poem, but instead, try to piece together small parts to understand a deeper meaning. Collin’s rules on how to interpret a poem can be applied to Hughes’s poem about a young student writing a poem for homework. Instead of looking at Hughes’s poem as a whole, the reader can better understand it by breaking it down and figuring out why each line is important and how it ties together with the poem as a whole. Understanding Collins rules to interpret a poem, help the reader decipher Hughes poem on a deeper, more academic level. Langston Hughes’s poem explains how a black, twenty two year old man and the rest of his white classmates are given an assignment to write a paper. The narrator, who is also the student, explains his thoughts about the assignment and how him being the only colored one in his class might be reflected on his grade on the assignment. At the beginning of the poem, he explains how he has to get to class everyday by traveling across some of the â€Å"better† parts of town. The student goes on to explain how even though he is colored, he likes the same things and has the same wants as everyone else. He states that he is no different than the rest of his class and that he too has knowledge to share. By stating this, the student is expressing to the reader how he thinks him and the instructor are equal. In the last few lines the student writes, â€Å"As I learn from you, / I guess you learn from me† (37-38). This explains how even though their skin color and age is different they are still able to learn from each other. The student has a somewhat optimistic and confident tone throughout the poem. He is aware of his capabilities and knows that he can be just as successful as anyone else. Billy Collins â€Å"Introduction to Poetry† explains how whenever people analyze a poem they do not try to find the true message of it. By writing, â€Å"But all they want to do / is tie the poem to a chair with rope / and torture a confession out of it,† explains how the majority of people are lazy and want everything handed to them effortlessly (12-14). This last stanza explains how some people look at poems from one point of view and expect the meaning of the poem to be written out for them. The author is stating that people should look at the poem from different angles just as one would look at the world from a color slide. He tries to explain to the reader that if one were to interpret the poem from a whole new approach, then they could find a deeper meaning than just the surface meaning. After reading Collins â€Å"Introduction to Poetry†, the reader should have a better sense of how to interpret Hughes’s poem. Throughout the first part of Hughes’s poem the reader may think all of the characters background information including his address, age, and hometown is pointless. After reading an entire stanza about this â€Å"pointless† information the reader may try to stop understanding the poem before they even finish it. If the reader uses Collins instructions about analyzing a poem, they may find that all of this â€Å"pointless† information is actually important and helps contribute to the characters feelings of insecurity. Collins poem explains that not all poems have one specific answer or meaning the writer is trying to get across. Keeping this idea in mind, the reader may realize that Hughes’s poem, in fact, does not state an answer or solution to the characters mixed feelings. Although both of these poems leave room the readers own special interpretation, there is a basic meaning and idea to each one. Both of these poems fit well together because Collin’s thoughts and ideas can be directly applied when reading Hughes’s poem. The poems are an effective example of how even though a poem may seem short and simple, there is usually a deeper and greater meaning beneath the surface.

Marx and Epicurus Theories of a Happy and Meaningful Life What is the picture of the point of human life implicit in Marxs discussion of alienation, and how does this picture contrast with the views of Epicurus? Explain which of the two views you find more plausible and why. The purpose of this paper is to evaluate the contrasting views of Marx and Epicurus for a happy and meaningful life, and ultimately support the view of Marx over that of Epicurus, because it is more relevant in current times and a way of live. This paper will develop two arguments, by which Epicurus will disagree with Marx. The first is that Marxs concept is mostly related to materialistic considerations, where Epicurus focuses on contemplation, pleasure, and friendship. Secondly, Marx does not consider people to be intelligent, where for Epicurus wisdom is the most valuable thing in life. According to Marx, with the emergence and development of capitalism people work to live and they choose work to afford other things, not for the work itself. They relate to a product that is not related to them and are thrown into â€Å"forced labor†, which disconnect them from human nature (p. 2). Therefore, Marx sees importance in the relation between labour, production and reality with human nature (p. 3). One is alienated from his/her productions and he/she is driven away from his/her nature, and consequently from other human beings, then â€Å"nature is taken away† (p. 3). Because everybody is employed in the machine of economical forces one cannot see any actually free human beings to relate with â€Å"one man is alienated to another, just as each of them is alienated from human nature† (p. 4). Marx disapproves of capitalism. He believes such an economic system is inferior as it leads to estranging people from their production, or alienation of the thing, f rom the act of production the relationship of the worker to his own activity as an alien activity, from their human species and from other people (pp. 2, 3). Thus, Marx believes that what makes us human is the conscious ability we have to be creative in a universal act of production (p.3). Therefore, capitalism deprives one from being a human. However, according to Marx the meaning and happiness of life are embedded and related to materialistic considerations. One is unhappy, because he/ she produces â€Å"commodities† and he/ she is not related to them (Marx, 1844, p. 1). Capitalism leads to alienation of product, and this leads to all other alienations that Marx talks about, which makes ones life unhappy. Therefore, if he was related to those commodities, he would be happy. Thus, according to Marx, activities and products are essential for our happiness. Epicurus concept is built on a pursuit of pleasure, which one could conceive with the elimination of mental and physical pain. He sees wisdom as the most valuable virtue of all. Where, the most precious thing that wisdom could attain is friendship, from all the â€Å"means that wisdom acquires†¦the most important is friendship† (Epicurus 2, p. 2). Therefore, Epicurus concentrates its discourse on the importance of a non-materialistic world. He believes in one living wisely, honourably and justly with directed interests toward tranquility of the mind. This is what Epicurus sees as a pleasurable and happy life â€Å"we call pleasure the alpha and omega of a happy life† (Epicurus 1, p. 2). Therefore, Epicurus will disagree with Marx. Products, no matter in what way created, should not be of primer importance for one to be happy. Friendship is something that can not be simply produced, but is an established connection with another human being, through common interests, visions, discussions, unrelated to material production. Marx believes that people are not happy in a capitalists society, because they are dehumanized and alienated from everything in their life. Thus, Marx talks about a universal act of production that enables one to feel as a â€Å"free being† (Marx, 1844, p. 3). However, none of his arguments considers one to be an intelligent human being. Moreover, he says that capitalism and mass production leads to â€Å"imbecility and cretinism for the worker† (Marx, 1844, p. 2). His concept is based on the relation of humans to their nature, and therefore closer to their instincts. Thus, their belonging to the natural is substantial and it is before a process of active reasoning in their life. In Marxs words, in terms one to be happy, he/she must be mainly active in a physical way, not on a mental level. However, one could be intellectual, when he/ she works and his/ her object of labour is â€Å"objectification†. This â€Å"objectification†, on the other hand, is relat ed to the absence of alienation from ones production (Marx, 1844, p. 3). Where, Epicurus idea about pleasurable life is highly tied with the notion of one being wise. He says that a wise man or woman, that ultimately would be a happy man or woman will always think about what he/she does in his/her life and â€Å"greatest interests†¦ will be, directed by reason throughout his [her] whole life† (Epicurus 2, p. 1). Thus, Epicurus believes that there is no such thing as a chance in the life of a wise man or woman. If a wise man or woman is experiencing â€Å"misfortune† in his/her life that is much better thanâ€Å"prosperity of a fool† (Epicurus 2, p. 2). Therefore, if Marx does not consider people to be wise, if they overcome the capitalists machine of dehumanization, it would be a chance, and their happiness would not be a real happiness, according to Epicurus. However in my personal opinion, living in a dominant western capitalist society, constrains people in the way that Marx describes. If you ask me if I am happy, I will never explain it in terms of other emotions or pleasures, pain or wisdom. I will talk about my experience as a human being, what I achieved in life, school and career. I will explain it with relationships to other human beings in my life. This does not mean that I don not have a life of reason, or I am not employing my intellectual abilities in my life. Even if something happens by chance in my life I would appreciate and enjoy it the same way as everything that I have planned. Thus, I believe that what we feel defines our life. When we talk about happiness and pleasure, those notions seem to be very short-sighted consideration. The meaning of mine life is a feeling about what I will leave after me, what I will achieve and how I will contribute in to this world. Does not always matter how something happens in our life, if it makes us feel complete and in touch with our instincts and nature, as Marx would agree. Moreover, relation to a universal labour and production is what better defines my vision for the world we live in. Going to work nowadays is a must for one to maintain at least basic living standards. We do not spend enough time with our families and friends. We are enslaved in life, scheduled by our work. Thus, we spend so much time doing something, which results in products and services belonging to somebody else. Moreover, the social structure that we are part of makes work, production and consumption more important than our nature as human and social beings. In my opinion, no matter how much reason and wisdom we put in our actions, we will define our life, by our productivity, relations to nature and material considerations which consequently is much closer to Marxs concept. The Triangle Shirtwaist Fire of 1911 :: United States History Work Safety Essays

The Triangle Shirtwaist Fire of 1911 275 girls started to collect their belongings as they were leaving work at 4:45 PM on Saturday. Within twenty minutes some of girls' charred bodies were lined up along the East Side of Greene Street. Those girls who flung themselves from the ninth floor were merely covered with tarpaulins where they hit the concrete. The Bellevue morgue was overrun with bodies and a makeshift morgue was set up on the adjoining pier on the East River. Hundred's of parents and family members came to identify their lost loved ones. 146 employees of the Triangle Shirtwaist Company were dead the night of March 25, 1911. The horror of their deaths led to numerous changes in occupational safety standards that currently ensure the safety of workers today. At the time of the fire the only safety measures available for the workers were 27 buckets of water and a fire escape that would collapse when people tried to use them. Most of the doors were locked and those that were not locked only opened inwards and were effectively held shut by the onrush of workers escaping the fire. As the clothing materials feed the fire workers tried to escape anyway they could. 25 passengers flung themselves down the elevator shaft trying to escape the fire. Their bodies rained blood and coins down onto the employees who made it into the elevator cars. Engine Company 72 and 33 were the first on the scene. To add to the already bleak situation the water streams from their hoses could only reach the 7th floor. Their ladders could only reach between the 6th and 7th floor. 19 bodies were found charred against the locked doors. 25 bodies were found huddled in a cloakroom. These deaths, although horrible, was not what changed the feelings toward government regula tion. Upon finding that they could not use the doors to escape and the fire burning at their clothes and hair, the girls of the Triangle Shirtwaist Company, aged mostly between 13 and 23 years of age, jumped 9 stories to their death. One after another the girls jumped to their deaths on the concrete over one hundred of feet below. Sometimes the girls jumped three and four at a time. On lookers watched in horror as body after body fell to the earth. "Thud -- dead; thud -- dead; thud -- dead; thud -- dead.

Jerry Springer versus Oprah Winfrey Show :: Daytime Television TV

In the world of entertainment, TV talk shows have undoubtedly flooded every inch of space on daytime television. Many of us have seen and heard the often recycled topics found on such veteran shows as Geraldo and Sally Jessy Raphael. And anyone who watches talk shows on a regular basis knows that each one varies in style and format. One might enjoy watching the sometimes trashy subject matter found on Jenny Jones, while someone else might prefer the more serious and light hearted feel of the Maury Povich show. But no two shows are more profoundly opposite in content, while at the same time standing out above the rest, than the Jerry Springer and the Oprah Winfrey show. Jerry Springer could easily be considered the king of "trash talk." The topics on his show are as shocking as they get. For example, the show takes the ever common talk show themes of love, lust, sex, sexuality, adultery, cheating, guilt, hate, conflict and morality to a different level. In a vintage Springer show, one finds women who cheated on their boyfriends and are ready to confess. But the boyfriends are in for a bigger surprise. As it turns out that all the women haven't been secretly seeing other guys, but seeing other women, who also happen to be waiting backstage. Another episode tells of a John Wayne Bobbit type case, but with a more twisted plot. A male cuts off his own manhood because he claimed that his homosexual neighbor was stalking him. Shocking, indeed, but the list of talk material goes on from dangerous love triangles, broken homes, pregnant strippers, teenage prostitutes, adult film stars, devil worshippers and the ever popular talk show regulars, the members of the Ku Klux Klan. Clearly, the Jerry Springer show is a display and exploitation of societies moral catastrophes, yet people are willing to eat up the intriguing predicaments of other peoples lives. Oprah Winfrey was once a follower of the trash TV format, but her long running popular TV talk show has since been reformed. Like Jerry Springer, the Oprah Winfrey show takes talk TV to its extreme, but Oprah goes in the opposite direction. Oprah is probably the most immaculate talk show there is. It is unlikely that you will find guest on Oprah that have committed adultery, have sold their souls to the devil, or are part of a racist hate group. Instead, the show focuses on the improvement of society and an individuals quality of life. In the Eyes of the Beholder The Contrasting Views of American Culture between Foreign and American Musicians The crowd of over 60,000 bursts into a thunderous uproar as the stadium suddenly becomes dark and anticipation rises like the temperature under a blazing Georgian July sun. After a seemingly infinite wait, one solitary image suddenly lights up from the seventy-foot video screen: an American flag. The Star Spangled Banner then booms from the massive speakers with the crowd growing frantic in the waiting for what is next. The national anthem fades out with â€Å"o’er the land of the free...† and a brief silence exists before a fierce drum beat begins, pounding away as the crowded frenzy is at an ecstatic high. A voice soon booms across the stadium, â€Å"and the home of the braaaaave† rattling it like a kitchen cupboard full of plates and glasses when a train passes by. The stage lights up and there on the massive stage set are U2. Lead singer Bono is lit up by a spotlight dressed in all black leather, sunglasses, and an American flag bandana. After a sc reeching guitar intro from The Edge, Bono breaks into the lyrics for the song â€Å"Bullet the Blue Sky,† an outsiders take on America. The show has begun. As with beauty, what actually is American life and culture is in the eye of the beholder. There is a large discrepency between the views of Americans on their own lives and that of inhabitants of other nations. The American dream of opportunity and freedom is well illustrated in its popular music. On the other hand, foreign artists usually take a more critical approach to American life with their views coming from the opposite end of the looking-glass. The educational needs being addressed will be the basis for Part A, which are, English as a second language (ESL), cultural diversity, social skills, intellectual disabilities and behaviour management. Pedagogical practices and strategies will be suggested to cater for the diverse learning needs of all children attending the service. The focus will be on the delivery of learning opportunities, according to need, to maximise students’ learning capacity and not to label the children. PART A English as a Second Language (ESL)/cultural diversity The case study states that the centre has a number of children with different cultural backgrounds. The first educational need relates to ESL and cultural diversity. Educators must respect the diverse cultural backgrounds and ensure equity, so children develop knowledgeable and confident self-identities (DEEWR, 2009). A positive sense of self is fostered when children are supported in their environment to feel safe, secure and supported (DEEWR, 2009). Early childhood educators should support students for whom English is a second language to develop their English language skills, empowering them to communicate and engage within their new environment. From the start of their enrolment, students and their families should be welcomed and feel a sense of belonging at the service. The centre’s philosophy should be based on an understanding that parents should be recognised as the child’s first and most influential educator, whilst supporting the National Childcare Accreditation Council’s quality area two ‘Partnerships with families’ (NCAC, 2005). In practice it has been found that, to support a smooth transition parents and child should be encouraged to have a settling in period, which can be used to share knowledge about the center; it’s curriculum and cultural background. Educators should exchange this information verbally as well as in a written form. During the settling-in period the child has the chance to meet new friends and to become more familiar in their new environment, whilst in the comfort of their parents. Enrolment strategies are to understand, support the child, his/her families and caregivers and to differentiate your program to support all cultures. Educators should build an understanding of individual culture including â€Å"norms, values, beliefs, languages, traditions, behaviours, symbols, activities, achievement, and possessions† (Ashman & Elkins, 2012). Educators can familiarised themselves with the families’ beliefs and values by providing the parents with English-language programs or translators, helping by collaborating and giving continuing support. Using these strategies to encourage family participation within the centre will support cultural diversity and an understanding of the world we live in. Example of  this would be celebrating cultural days, such as Naidoc week within the Aboriginal culture. Workers in the industry report that ways in showing a cultural understanding is to ask families to bring in family photos for display, to provide familiar words from their native language or invite them to talk about their culture or share a special dish are other possibilities. This will help ease the child into the classroom environment. To support the child, strategies such as simplifying language, making instructions clear, breaking down the steps, providing multiple technology devices of communication and observations to recognise confidence could be used. Have classroom routines and consistent expectations to help the child understand what they are expected to do. Educators should ensure individual expectations are clear and understood by children to reduce frustration and barriers from being formed (Ashman & Elkins, 2012). Social Skills The second educational need is the inclusion of social skills. Educators have the responsibility to provide a welcoming and safe environment, where children feel accepted and part of a group. Through social interactions children can share knowledge and develop confident self-identities (DEEWR, 2009). Educators should identify each student’s positive characteristics then use them to establish an understanding of interests to keep them engaged. This helps move towards an inclusive environment. An inclusive classroom should provide a safe, flexible learning environment where all students have sufficient support to achieve outcomes consistent with their capabilities, become willing to take risks, and construct knowledge that is personally relevant and meaningful. Differentiating the program experiences and assessment by taking on an individualised approach aims to promote success and self-esteem (Ashman & Elkins, 2012). It cannot be assumed that social inclusion will occur automatically to new students (Ashman & Elkins, 2012). Strategies to encourage social inclusion are to ensure all students are actively involved in the organisation of the classroom; the educator thus needs to build a positive relationship with the student, providing opportunities for social interaction in group work, games and activities. Educators are qualified enough to support students’ friendships and ensure that their classroom is socially responsive. Following up on these aspects should be done promptly with regular observation and review on progression  in social skills from the child. Through anecdotal evidence, documenting these observations have shown to support the reflection process and assist in justifying and preparing plans for the child’s individual needs, interests, strengths and weaknesses (Churchill et al, 2013). Intellectual disability The third educational need is the inclusion of children with intellectual disabilities. All schools aspire to have collaborative, school-based terms that are organised to develop supportive networks for students, including the intellectually disabled. Educators should recognise strengths and capabilities and not make assumptions about the students’ ability based on their diagnostic label. Reasonable steps should be taken to ensure students with disabilities are given multiple means for participating in learning. These would involve learning through multiple, examples, media and formats, choice of context and tools, opportunities for demonstration and level of challenges. Give students plenty of options for expressing what they know, and provide models, feedback and support for their different levels of proficiency (CAST, 2012). Multiple strategies can be guided by the principles from the ‘Universal Design for learning’, which is a framework that shifts educators’ understanding of learner differences. It challenges them to rethink the nature of curriculum materials and endow them with the inherent flexibility necessary to serve diverse learning needs (Wright, 2006, as cited in Module 4, 2014). Strategies that also facilitate this include, varying the type of activities or the method of instruction, providing additional human and technical resources, giving extra support, modifying the ways in which the student will respond, or changing the classroom environment. These variations should be designed in such a way that the student with a disability is able to participate in the learning experiences on the same basis as a student without a disability, and without experiencing discrimination. There is anecdotal evidence that contemporary approaches to intellectual disability emphasise equal ac cess, participation, and recognition that a person’s level of functioning will improve if appropriate, individualise and supports are provided. Behaviour management The fourth educational need is behaviour management. Before considering specific learning issues, there are a number of factors outside of the school that influence school behaviour issues; family, socio-economics, culture, religion and race; and socio-political factors. Educators should agree that it is important to establish a cohesive understanding of socio-culturally acceptable behaviours when addressing behaviour management. Strategies to encourage positive behaviour rely on a pedagogical approach that sees the educator making adaptations, so the students can work effectively. In practice is has been found that students with behaviour problems often learn best when tactile and kinaesthetic strategies are presented. According to Early Childhood Australia (2013) the two main reasons misbehaviour usually occurs is when, children are expressing their feelings and children who have not yet learnt how to do what is expected. Strategies aimed at preventing misbehaviour include setting clear limits with input from the children and teaching the children what behaviour is appropriate and what is not (Early Childhood Australia, 2013). A critical aspect of maintaining students with behaviour problems in an inclusive classroom is the recognition of the learning difficulties that students face (Mooney, Epstein, Reid, and Nelson, 2003, as cited in Ashman & Elkins, 2012). One of the most important strategies for any teacher is to be a role model and to create a supportive and welcoming classroom. This will encourage all students to persist and work together more inclusively. To encourage appropriate behaviour, staff to child ratios should be obeyed at all times. This will ensure adequate care is been given to each child. Routines to be followed, keeping mealtimes regular and not too late, as some children will be hungry and this can lead to misbehaviour due to irritability. This can be changed by being responsive, flexible and adopting an individualised approach to routines. However sometimes circumstances change suddenly and this can result in routines been disturbed, for example, changes at home and the circumstances affecting behaviour is out of your control. The main idea is to facilitate individuals in developing his or her authentic self, through fostering student’s knowledge in a number of different genres, within a school, family or social environment. As a result of the diverse economic, social, spiritual, cultural, and political realities of our individual lives, a single aim of education wouldn’t suit  everyone’s needs. Therefore we need to create opportunities that will lead a student to their own success, a success defined by the individual. After all research has shown that â€Å"the way children learn, is as unique as their fingerprints† (CAST, 2012). Including students with educational learning needs in the regular classroom will provide the children with opportunities to interact with more able peers. By interacting in small groups, students learn to listen to what others have to say, understand that they may have different perspectives, share information and ideas and express different points of view in socially acceptable ways. Although it may appear that time and considerable organisation is focused on children with educational needs, it will have a positive impact on the delivery of the curriculum. The strategies outlined can be used not only for the child in need but all other children in the class will benefit from the additional strategies that will in turn cater for the multiple ways of learning throughout the class. PART B The Early Years Learning Framework (EYLF) is Australia’s first national framework, which forms an important written guideline for the unity of care and practices ensuring all children involved in early childhood education settings experience quality teaching (AGDEEWR, 2009). The EYLF’s curriculum supports children’s learning from birth to five years of age, as well as their transition to school. Part A mentions strategies that relate to the EYLF’s curriculum The ‘Being, Becoming and Belonging: The Early Years Learning Framework is the document used in all services implementing the National Quality Standard. It consists of a set of principals, practices and outcomes that advise educators that children have a strong sense of identity, children are connected with and contribute to their world, children have a strong sense of wellbeing, children are confident and involved learners and children are effective communicators. Strategies suggested in Part A directly relate to these outcomes from the EYLF by advocating play-based learning while recognising the importance of communication, language, social and emotional development (ACECQA, 2009). All elements are fundamental to curriculum making decisions and pedagogy in an early childhood setting. The National Quality Framework (NQF) is a tool to assist childcare providers to improve their services in the areas that  impact on a child’s development and empower families to make informed choices about which service is best for their child. The NQF has many implications for the centre, including a national legislative framework that consists of the Education and Care Services National Law and Education and Care Services National regulations, a National Quality Standard (NQS), an assessment and rating system, a regulatory authority and ACECQA. ‘The Guide to the National Quality Framework’ directs centres in implementing the framework. The National Quality Standard is responsible for administering, including approving, monitoring, and quality assessing and rating. Services are assessed and rated against the Seven Quality Areas; this ensures the organisation and its educator’s are meeting the standards and providing high-quality educational programs. The Seven Quality Areas that relate to all practices outlined in Part A, are; Educational program and practice, Children’s health and safety, Physical environment, Collaborative partnerships with families and communities, Staffing arrangements, Relationships with children, Leadership and service management. Education and Care Services National Law (Queensland) Act 2011 outlines the legislation that has implications for the service. It outlines regulations regarding inclusion and provisions. The National law establishes the ACECQA, which is responsible for ensuring that the NQF that is implemented consistently across all states and territories. The Child Care Regulation 2003 directs policies and outlines the lawful standards that implicate the service. These regulations implicate all practices and strategies outlined in Part A, by providing a directive for compliance. The United Nations Convention on the Rights of the Child (UNCRC) sets out rights in 54 Articles and is guided by four fundamental principles. The articles are about how adults and governments should work together to make sure that all children get all their rights. The four fundamental principles are, non-discrimination, the best interests of the child, survival, development and protection and participation. These protocols have implications for the service with its outline of the basic human rights that children everywhere have. This is put in place to ensure that services are meeting the basic needs of ch ildren, to help them reach their fullest potential. Many of the rights support planning strategies outlined in part A including the right to his or her own name and identity, the right to an education, the right to be  protected from abuse or exploitation, the right to express their opinions and have these listened to and, where appropriate, acted upon and the right to play and enjoy culture and art in safety (UNICEF, 2012). The Disabilities Discrimination Act (DDA) education standards outline the obligations to assist people with a disability under the DDA. The DDA therefore has direct implications for the service when catering for children with disabilities to ensure their right to participate in educational courses and programs on the same basis as students without disability. This means a person with disability should have access to the same opportunities and choices in their education that are available to a person without disability. These policies support the planning and implementation of differentiated learning, assessment, accommodations, adjustments, re-designing and the universal design for learning. Melbourne Declaration outlines a commitment to working to support the development and strengthening of early childhood education, to provide every child with the opportunity for the best start in life and there for has implications for the service. The ‘Commitment to Action’ supports the planning for part A in such areas as developing stronger partnerships and strengthening early childhood education, advocating services to work towards smooth transitions into schools, providing parents, carers and families with information regarding equity and supporting young Australians to become successful learners, confident and creative individuals and active and informed citizens (MCEECDYA, 2008).
